SC Disbars Former IBP Officer Involved in Fake Annulment of Marriage Decisions

The Supreme Court has disbarred a former officer of the Integrated Bar of the Philippines (IBP) – South Cotabato and General Santos Chapter for violating the Lawyer’s Oath and the Code of Professional Responsibility (CPR) in connection with his involvement “in the reprehensible practice of perpetuating annulment packages.”


The Court held that Atty. Rojas failed his Oath, especially considering his qualifications as a former officer of the IBP South Cotabato and General Santos Chapter, a former law professor, and officer of various civic organizers. It said: “Atty. Rojas deliberately defiled the legal profession and was utterly remiss in his duties to the profession, to the society, and to the courts.”


The CPR, particularly Canon 1, requires the lawyer to uphold the Constitution, obey the laws of the land, and to promoted respect for law and legal processes. Rule 1.01 sets the path in doing so, viz: A lawyer shall not engage in unlawful, dishonest, immoral or deceitful conduct. It added that Rojas’s actions likewise defied Canon 10 of the CPR which mandates that a lawyer owes candor, fairness, and good faith to the Court.


The Court went on to declare that Rojas has not met the guidelines set by the Court to consider granting him clemency. It stressed that Rojas must first be held accountable, acknowledge his transgressions, and suffer the penalty therefor.
