Bar Review Tips | 2023

Image
My tips for those preparing for the September bar examinations and for those intending to take the bar examinations in the near future.  My advice to those preparing for the September bar examinations and those planning to take the bar examinations soon.  Learn to let go of things |  We must pay great attention and focus on preparing for the bar exam. Make a study plan for us to cover the whole bar exam material. We will be able to maximise our limited time if we have a specific plan for each bar subject. We will have to deny invites to birthday parties, family reunions, and even socialising with our peers since we must adhere to a strict study regimen. I do not want to imply that we spend the entire day studying alone. We can maintain contact with family and friends while maintaining a healthy balance, but this should not interfere with our reading time. Let them know and understand what is going on as we prepare for the bar. We can still go to church or meet up w...

New lawyer brings cardboard standee of parents to Roll of Attorneys signing

New lawyer brings cardboard standee of parents to Roll of Attorneys signing |  Told that visitors are not allowed amid the COVID-19 pandemic, a new lawyer found another way of bringing his parents to his signing of the roll at the Supreme Court on Thursday.  Instead of physically bringing his parents, Atty. Aivan Torres just brought a standee of them.  According to Torres, he wanted to share the moment with his parents but was told he could not bring guests. ✍️ Published July 23, 2020 📸: #GMANews | Tina P. The waiver of Article 125 of the RPC

Image
RE: The waiver of Article 125 of the RPC does not vest upon the DOJ, PPO, BJMP, and PNP the unbridled right to indefinitely incarcerate an arrested person |  The rule is that a person subject of a warrantless arrest must be delivered to the proper judicial authorities within the periods provided in Article 125 of the RPC, otherwise, the public official or employee could be held liable for the failure to deliver except if grounded on reasonable and allowable delays. Article 125 of the RPC is intended to prevent any abuse resulting from confining a person without informing him of his offense and without allowing him to post bail. It punishes public officials or employees who shall detain any person for some legal ground but fail to deliver such person to the proper judicial authorities within the periods prescribed by law. In case the detention is without legal ground, the person arrested can charge the arresting officer with arbitrary detention under Article 124 of the RPC. T...

'I got used to failure': Three-time bar flunker, now a lawyer

Image
'I got used to failure': Three-time bar flunker, now a lawyer |  "My past failures taught me the importance of working hard and having a strong foundation in the basic principles of law. So, I created a strict study schedule and stuck to it, sacrificing social outings with friends and limiting my time on social media. I selected only the necessary review materials and carefully chose who I interacted with. Above all, I refused to be swayed by the negativity and distractions around me and relied on prayer to keep me focused." [...]  "I feel no shame in openly sharing that I failed the bar exams not just once, but three times. This serves as a reminder for me to never forget my humble beginnings, the obstacles I overcame, and to remain grounded."  We have different stories to tell. My progress is not the same with the progress of others.  RELATED | Bar review tips | from a 2022 Bar Passer For those who did not pass this year's BAR examination, do not lose...

Rep. Marcoleta led the filing of a measure that seeks to regulate the "paluwagan" system.

Image
SAGIP Party-list Rep. Rodante Marcoleta led the filing of a measure that seeks to regulate the "paluwagan" system. Marcoleta said the system is not without its downsides.  "Although paluwagan has been in existence since time immemorial, the practice remains informal and unregulated. Anyone can form a group through verbal agreements. It is not regulated by any governmental body,"  said HB No.7757. "Since the system only relies  on trust, it also becomes prone to fraud. Since most paluwagan [systems are] unregistered and undocumented, it is hard to prove claims of losses and damages in court,"  it further said.  Under the measure, an independent agency to be called Paluwagan Microfinance Administration will be created. And the Paluwagan Insurance Fund, which will protect members of insured paluwagan in case of cessation of business.  📸: #ManilaBulletin | https://bit.ly/www_faceboook-mystories_orig_post Read more: 🔗 https://mb.com.ph/2023/4/15/last-in-...
